Terms and conditions | Happy Homes Bonaire

These general terms and conditions apply to every reservation with Happy Homes Bonaire. By making a reservation, and once Happy Homes Bonaire has confirmed it, you as the tenant agree to these terms. Where these terms say villa, this also includes houses, apartments and studios.

1. Risk and liability. You use the villa, its interior and all facilities, including gardens, swimming pool, pool deck, gazebo and sea access, at your own risk. You accept full responsibility for any personal injury or death of yourself, your family or your guests during the rental period. You release the villa owner (or business owner) and Happy Homes Bonaire from any liability for such incidents. You make sure your family and guests are aware of these risks.

2. Damage and security deposit. You are financially responsible for any damage to the villa, its interior and facilities, including the swimming pool, garden and gazebo. A security deposit of USD 250 is pre-authorized on your credit card on arrival. Damage or additional charges may be deducted from this deposit. Happy Homes Bonaire releases the deposit 3 days after departure, minus any costs incurred. If the damage is higher than the deposit, you pay the additional costs.

3. No liability for loss of property. Neither the villa owner nor Happy Homes Bonaire is liable for loss, theft or damage to personal belongings, including items kept in a safe (where available). You arrange your own insurance for this. Happy Homes Bonaire is also not responsible for any inconvenience caused by power outages, repairs or construction near the villa. No compensation or refund is given in these situations.

4. Payment terms. A non-refundable deposit of 25% is required to confirm the reservation. The remaining balance of 75% must be paid 40 days before the rental period. Payment is made by credit card or bank transfer, and any bank or credit card fees are for your account. If payment is not made on time, the reservation may be canceled. If the security deposit of USD 250 cannot be authorized on your credit card, you pay this amount in cash or by bank transfer on arrival.

5. Cancellation by the tenant. Cancellations must be made in writing, by email. For a cancellation more than 40 days before the rental period, you pay 25% of the total booking cost. For a cancellation within 40 days before the rental period, you pay 100% of the total booking cost.

6. Cancellation or changes by Happy Homes Bonaire. Happy Homes Bonaire may cancel or change a reservation because of unforeseen circumstances, including force majeure such as natural disasters, war or strikes. Where possible, alternative accommodation is offered. If that is not possible, amounts already paid are refunded. Happy Homes Bonaire is not liable for any further damage resulting from such a cancellation.

7. Governing law and jurisdiction. These terms and conditions are governed by the law of the Caribbean Netherlands. Disputes are submitted exclusively to the court of Bonaire.

8. Insurance. You are responsible for arranging travel insurance that covers accidents, damage, loss and cancellation during your stay.

9. Reservations. A reservation is only final once the 25% deposit has been received. You are responsible for checking the reservation details and reporting any errors within 5 days. Happy Homes Bonaire may refuse non-standard or group bookings, or apply additional conditions to them. Subletting is strictly prohibited.

10. Accommodation. Check-in is from 15:00 and check-out is by 11:00, unless agreed otherwise. The maximum number of guests is based on the original reservation, and extra guests may be charged. You follow all instructions about the equipment and upkeep of the villa. The villa is non-smoking. Pets, parties, loud music and large events are not allowed unless agreed in advance. Happy Homes Bonaire may evict tenants who break these terms. In case of unforeseen circumstances or the sale of the property, Happy Homes Bonaire may move guests to a similar villa at the same rate. Lost or damaged keys and remote controls are charged: USD 100 for an electric gate remote and USD 25 for a key.
